On February 13, 2020, a meeting of the Qualification Commission of the Chamber of Lawyers of the Samara Region was held. It marked the end of the 18-year period of work in accordance with Article 33 of the Federal Law “On Advocacy and the Bar in the Russian Federation” dated May 31, 2002 No. 63-FZ, which has undergone changes in accordance with Federal Law dated 02.12.2019 N 400-ФЗ “On Amending the Federal Law “On Advocacy and the Bar in the Russian Federation”.


New edition of Art. 33, which comes into force on March 1, 2020, excludes the possibility of lawyers to combine membership in the Chamber Council and the Qualification Commission, and paragraph 3 of Article 33 of the Federal Law No. 63 establishes that “the chairman of the qualification commission is elected by a simple majority of votes of the members of the commission. The president of the bar is not a member of the commission. ” Such changes are aimed at democratizing the activities of law enforcement authorities, which implies significant changes in the work of the Qualification Commission, which has a more independent role.

In order to prepare for new principles of activity, the PASO Qualification Commission since December 2019 began to work in an amended format. On December 5, 2019 and January 16, 2020, “test” sessions were held, during which all attorneys-members of the commission reported on the circumstances of the disciplinary proceedings under consideration, thereby developing the skills to establish and present legally significant facts. Each member of the commission “tried on” the format of the “judge of honor”. As it turned out, this is not so simple when the correctness of the actions of a colleague on the claims of the applicants (principals, judges) is examined. Despite the minimum number of disciplinary proceedings included in the agenda (13 and 18, respectively), the length of meetings increased significantly.

As part of today's meeting, PASO President T.D. Butovchenko proposed “passing the baton” to the chairperson of one of the members of the Qualification Commission, who in writing indicated a desire to continue working on the commission after the elections to be held during the Twelfth Annual Conference of Lawyers of the Samara Region on April 16, 2020.

According to the President of PASO, today's meeting was a success.

The new rules for the activities of the Qualification Commission, which shared the functions of the President of the Bar and the Chairman of the Qualification Commission, required certain efforts to equip a workplace for meetings and organize 13 workplaces for members of the commission, secretary, and participants in disciplinary proceedings. Based on the goal of minimizing costs, the PASO Council decided to re-equip the cabinet, which previously had vice presidents. Thanks to personal initiative and material support from board members, chamber expenses were limited to the cost of 15 office chairs. The appearance of the cabinet has changed. Having held the meeting in a new format, the members of the commission were convinced that decent conditions had been created for the work of the future composition of the Qualification Commission.

T. Butovchenko: I would like to wish the number of pending complaints about the actions of lawyers to steadily decrease, and the Qualification Commission made efforts only to assess the knowledge of applicants for status.
